  • Legal form: vennootschap onder firma (V.O.F.), a general partnership under Dutch law
  • Address: Heije Schaperloane 13, 9269 PL Veenwouden, the Netherlands
  • Represented by: Marieke Reitsema
  • Trade register: Netherlands Chamber of Commerce (KvK), number 42105678

  • Email: support@cashbackie.com

These details are also on our company information page. The quickest way to reach us is through support in your account; you'll find other ways on the contact page.

2. Definitions

  • Cashbackie: the service we provide through cashbackie.com.
  • Member: a natural person with an account at Cashbackie.
  • Shop: a third party that sells goods or services and works with Cashbackie.
  • Cashback: the amount you get back for a valid purchase made through our site.
  • Affiliate network: an intermediary (for example Awin) through which Cashbackie and the shops work together.

3. What Cashbackie does and how we make money

3.1 Cashbackie doesn't sell any goods or services itself. Through our tracking links you go to partner shops and can buy there. Every contract of sale is between you and the shop, on the shop's terms. We are not a party to it.

3.2 Your rights on a purchase, such as returns, shipping and warranties, are therefore rights against the shop and not against us. For questions about a product or a delivery, please contact the shop.

3.3 This is how we make money: when you make a valid purchase through our links, the shop pays us a commission through the affiliate network. Your cashback is part of that commission. So every link to a shop on our site is an affiliate link, and with every shop there is a contractual relationship, directly or through the network. No shop can pay for a better position. How shops are selected and ordered is explained on the page How we rank shops.

4. Signing up and the contract

4.1 Membership is free. You don't take on any obligation to pay, and there is no subscription. The contract runs for an indefinite period; you can end it at any time, free of charge (section 12).

4.2 You sign up with your email address by accepting these terms and our privacy notice and then confirming your email address, or with a Google or Facebook account. Before you submit the form you can check and correct what you have entered. The contract is made when your account is created.

4.3 The contract is made in English. These terms are always available on this page; you can save or print them. We record when you accepted them.

5. Ending your membership

You can end your membership at any time, for any reason and free of charge, by deleting your account in your dashboard ("Delete account") or by writing to support@cashbackie.com. As membership is free, there is nothing to pay or repay. Section 12 explains what happens to your balance. For a purchase from a shop, that shop's own return and cancellation policy applies (section 3.2).

6. Your account

6.1 Members must be at least 18 years old and have an email address and a US bank account (routing number and account number) in their own name.

6.2 Each person may have only one account. If someone has more than one account, or in the case of fraud, we can block the extra accounts; cashback and rewards in those accounts then lapse.

6.3 You are responsible for making sure your information is correct and your login details are secure.

7. Cashback: when you get it

7.1 A conditional right. Your right to cashback only becomes final once the shop or the affiliate network has approved the purchase. Until then, there is no right to payment yet.

7.2 When there is no right to cashback. There is no right to cashback, or it lapses:

  • if the purchase is returned, canceled or not delivered;
  • if you use a voucher code that isn't on Cashbackie;
  • if the tracking didn't work (for example because of an ad blocker, your browser settings or because you shopped in several tabs);
  • if the shop or the affiliate network declines the purchase;
  • in the case of fraud, abuse or deliberate manipulation of the system;
  • for purchases that didn't go through our tracking.

7.3 Amount. How much cashback a shop gives is shown on its page and can change, for example when the shop changes its commission. We work out your cashback using the rate that applies to the shop when the purchase reaches us, usually a few days after your purchase; if an offer was running when you clicked, it is taken into account. The final amount depends on what the shop or the network approves, for example if part of your order belongs to a different product group or you return part of it. We never pay out more cashback than the commission we receive for your purchase.

7.4 Validation period. You can have approved cashback paid out after a validation period, usually 60 days (it can differ from shop to shop). The validation period covers late returns and cancellations of the commission by the shop.

8. Payouts

8.1 Minimum. You can request a payout as soon as your available balance is at least $10.

8.2 How we pay. Your balance is in US dollars. We pay it into a US bank account in your name, by bank transfer from our bank in the Netherlands; we don't pay out to third parties. For the transfer our bank needs your routing number, account number, account type and address. We don't charge for a payout. Your own bank may charge a fee for receiving a transfer from abroad; we have no influence on that.

8.3 Timing. We aim to pay out within 14 business days of your request. For large amounts or suspicious activity, an extra check may take place.

8.4 Checks. When you request a payout, we may check your identity, as part of our measures against fraud and our legal obligations.

8.5 Lapsing after inactivity. After a long period of inactivity, a remaining balance can lapse. See section 12 (Inactivity and ending the contract).

9. Claims

9.1 If your cashback was declined, not recorded or recorded too low, you can submit a claim through support in your dashboard. The claim conditions also apply.

9.2 A claim is no guarantee that you will get the cashback: we depend on the cooperation of the shop and the affiliate network. Some shops don't accept claims; if so, this is shown on the shop's page.

10. Inviting friends

10.1 For each new member you invite, you receive a reward (the current amount is shown on the "Invite friends" page) as soon as the member who signed up through your personal link and you have both received cashback on a purchase (available or paid out) and neither account is blocked. Members we have named as promoters, who are rewarded in another way, don't receive this reward.

10.2 Anyone who abuses the program, for example by inviting themselves with a second account, loses the reward.

10.3 If you share your link in a post, a video or anywhere else where people may not know that you earn from it, say clearly that you do (for example with #ad), as the Federal Trade Commission expects.

11. Fraud and abuse

11.1 You may not:

  • create more than one account;
  • manipulate or resell tracking links;
  • make purchases with the intention of canceling them right away;
  • use bots, scripts or automated tools;
  • obtain cashback for yourself through artificial purchases.

11.2 If we suspect fraud, we can block your account and freeze your balance while we investigate. If we establish fraud or abuse, the balance concerned can lapse and we may take legal action. You can object to our decision in writing.

12. Inactivity and ending the contract

12.1 You can end the contract at any time, without notice and free of charge, by deleting your account in your dashboard ("Delete account"). If a payout is in progress, this is only possible once it has been completed. You can also send your notice in writing to support@cashbackie.com. Your name and contact information are then deleted. A balance you haven't yet asked to have paid out, and cashback that is still pending, lapse at that moment; so have an available balance paid out first. We keep financial records for 7 years (a legal retention requirement).

12.2 Inactivity. An account counts as inactive if there has been no activity for 12 months in a row. Activity means: logging in (including automatically, if you stay logged in), clicking through to a shop via Cashbackie or receiving a new transaction.

12.3 Reminders first. Before we close an inactive account, we send you three reminders by email: roughly two months, one month and two weeks before. There are always at least 14 days between the last reminder and the closure. You prevent the closure by logging in again. If your available balance is $10 or more, you can also have it paid out.

12.4 Closure and lapse of the balance. If you don't use the account again after these reminders, we close it after 12 months of inactivity. The remaining balance then lapses, including cashback that is still pending or approved, and your name and contact information are deleted (we keep financial records without your name, because of the legal retention requirement). You can open a new free account at any time afterward.

12.5 We can also end an account if these terms are broken or in the case of fraud; for accounts without fraud, with reasonable notice.

13. Our responsibility to you

13.1 We put the information on the site together with care, such as cashback rates and amounts, descriptions of shops, conditions, voucher codes and links. Even so, it can be incorrect, out of date or incomplete, partly because we depend on data from the affiliate networks and the shops.

13.2 The final amount of cashback depends on what the shop or the affiliate network approves, as described in section 7.3.

13.3 We provide our service with reasonable care and skill. If we fail to comply with these terms, we are responsible for loss you suffer that is a foreseeable result of our breach. Loss is foreseeable if it is obvious that it will happen or if, when the contract was made, both we and you knew it might happen. To the extent the law that applies to you allows, we are not responsible for loss that is not foreseeable.

13.4 Above all, our job is to pass on a click we have received correctly to the network and to pay you the cashback we have received for you.

13.5 Nothing in these terms excludes or limits our liability where the law does not allow it, such as liability for fraud, for gross negligence or willful misconduct, or for death or personal injury caused by our negligence, and nothing in these terms takes away rights you have under consumer protection laws that cannot be waived.

13.6 The shop is responsible for the purchase itself: for the delivery, the quality of the product and your rights if it is faulty (section 3.2).

14. Changes

14.1 We can change these terms for the future if there is a valid reason, for example a change in the law, a new court ruling, a change in our service or in the terms of the affiliate networks, and the change is reasonable for you.

14.2 We will tell you by email about changes to your disadvantage at least 30 days before they take effect. If you don't agree, you can end the contract free of charge before then and have an available balance paid out.

14.3 We won't change the core of our service, in particular that membership is free, without your explicit consent.

15. Taxes and personal information

15.1 We don't withhold anything from your cashback and we don't give tax advice. You'll find a general explanation on the page Do I have to pay tax on cashback? For questions about your own situation, check IRS.gov or ask a tax professional.

15.2 How we process your personal information is explained in our privacy notice and our cookie policy. There you'll also find your rights, including your rights under the privacy laws of US states.

16. Complaints and disputes

16.1 If you have a complaint, please contact us in writing first, through support in your account or at support@cashbackie.com. We are happy to look for a solution with you.

16.2 We are not obliged to use an alternative dispute resolution provider.

16.3 You can also contact the consumer protection office of your state attorney general, or report a problem to the Federal Trade Commission (ReportFraud.ftc.gov).

17. Governing law and courts

17.1 The contract between you and Cashbackie is governed by Dutch law.

17.2 This choice of law does not deprive you of the protection of the consumer protection laws of the state where you live that cannot be waived by contract. That protection remains in full.

17.3 You can bring legal proceedings in respect of our service in the courts of the state where you live, or in the Dutch courts. We can only bring proceedings against you in the courts of the state where you live.
